What is the ‘As of Right’ Framework? New Ontario Labour Rules Explained

On December 31st, 2025, the Government of Ontario published a summary of the new provincial legislation and regulations. These regulations officially took effect on January 1, 2026.
Of importance for employers and qualified professionals is the introduction of the new “As of Right” labour mobility regulation. This falls under the Ontario Labour Mobility Act.
The “As of Right” Framework Explained
The “As of Right” framework is a First-in-Canada labour mobility regulation. Its goal is to break down interprovincial barriers for certified professionals seeking to work in Ontario.
It allows qualified professionals from other provinces to start working in Ontario faster. They can work while completing full registration with their local regulatory authority.
This First-in-Canada approach aims to unify our workforce. It strengthens our economic resilience and competitiveness following the 2025 tariff wars with the U.S. and recent economic uncertainty.
Professionals who are qualified in other provinces or territories can be deemed certified in Ontario within 10 business days. This happens once the Ontario regulatory authority governing their profession confirms their credentials. This quicker path is effective for up to six months. During this time, the professional completes their full registration in Ontario.
Which Professions Qualify?
The new “As of Right” rules apply across professions regulated by more than 50 regulatory authorities and 300 certifications, including the following in-demand certified professionals:
- Architects
- Engineers
- Geoscientists
- Land surveyors
- Electricians
Please consult Table 1 to the Ontario Labour Mobility Act for a complete list of the regulatory authorities and professions which are subject to the “As of Right” rules.
Impact on Healthcare Professionals
Additionally, the Ministry of Health has announced that an amendment will be made to O. Reg 865/93 under the Medicine Act to remove barriers to registration, streamline credentialing, and allow qualified physicians and nurses to practise in Ontario faster.
The College of Physicians and Surgeons of Ontario (CPSO) and the College of Nurses of Ontario (CNO) regulate these professions. They will now automatically recognize extra-provincial licences. They will register applicants who are in good standing in their home jurisdictions within two business days.
Further amendments to regulations under the Medicine Act will grant “As of Right” mobility to board-certified physicians and nurses licenced in a U.S. state and the District of Columbia.
Qualified Professionals seeking to relocate in Ontario should stay informed about their rights under the “As of Right” framework and consult their applicable regulatory authority for any transfer requirements specific to their profession.
